  87. Definitions.

  89. 'Software' or 'Program' means the ChaoSoft software product Folder Guard,
  90. including both the software and the associated documentation and other
  91. materials;

  93. 'Evaluation Copy' means a copy of the Program you obtained from us or
  94. other source for evaluation purposes and which is described as
  95. "Unregistered" in the 'About' screen. An Evaluation Copy may be converted
  96. to the Licensed Copy by supplying a name of a registered user or
  97. institution and a correct Registration Code, which may be obtained from
  98. ChaoSoft or its authorized dealer(s).
  99.  
  100. 'Licensed Copy' means a copy of the Program registered with ChaoSoft or
  101. with its authorized dealer, and which is described as "Registered to:
  102. <user name>" in the 'About' screen. A Licensed Copy converts itself into
  103. an Evaluation Copy when it is copied to another disk or computer, or when
  104. the registration information is erased.
  105.  
  106. 'Registration Package' means all the materials you are obtaining from us
  107. or our authorized dealer after sending us your registration fee. In
  108. particular, Registration Package contains your personal Registration
  109. Code, allowing you to remove the registration reminder message and put
  110. your name in the 'About' screen.

  112. 'we' or 'us' means ChaoSoft, a company produced this software

  116. 'you' means the end user or distributor of the Software.

  133. ChaoSoft and is protected by United States copyright laws and
  134. international treaty provisions. Therefore, you must treat the Software

  137. is granted to you. You may not copy any written or printed materials
  138. from your Registration Package and you may not rent or lease a Licensed
  139. Copy of the Software.

  141. TRIAL USE LICENSE

  143. ChaoSoft grants to you a limited license to use an Evaluation Copy of
  144. this software for evaluation purposes for a period not to exceed 14 days.

  146. This period may be not a contiguous sequence of days. However, you should
  147. count a day as an evaluation day if you used the Program during that day
  148. at least once. The purpose of this evaluation period is to allow you to
  149. determine whether the program meets your needs before purchasing it.

  151. Once the evaluation period has ended, you MUST either purchase a license
  152. for continued use of the program, or stop using it.  Use of an Evaluation
  153. Copy beyond the end of the evaluation period without registering it is in

  156. If you have sent out your registration fee, you may continue to use your
  157. Evaluation Copy beyond the end of the evaluation period until your

  160. Obtaining a license for continued use of the Program.

  164. your name, address, and correct amount of registration fee to our

  167. containing the Registration Code assigned to you, you may use that code
  168. to convert your Evaluation Copy of the Software into the Licensed one.

  170. You agree to keep the Registration Code for your own use only and
  171. not share it with anybody else.

  173. LICENSED COPY USE LICENSE

  175. ChaoSoft grants to you the right to use a Licensed Copy of the software,
  176. if you have registered (purchased a license for continued use) it with us
  177. or with our authorized dealer.

  179. You may install a Licensed Copy of the software on more than one computer
  180. (for example, a desktop system and a portable notebook), provided that
  181. you are the only user of those computers and there is no possibility to
  182. use the Licensed Copy by anybody else.

  184. You may not network a Licensed Copy or otherwise use it on more than one
  185. computer or computer terminal at the same time unless you have purchased
  186. a site license.
  187.  
  188. If the Licensed Copy you are using is registered to some other name, you
  189. MUST either unregister it by removing the registration information, or
  190. stop using it. Use of a Licensed Copy, registered to anybody else except
  191. you (or, for site license arrangements, to your organization), is in
  192. violation of federal copyright laws.

  194. Multi-User and Network Use.

  196. If you have registered the Software for use by multiple users,  you agree
  197. not to use the Program on more computers than the number specified in
  198. your site license. You may install the Program on computers attached to a
  199. network, or remove it from one computer and install it on a different
  200. one, provided there is NO POSSIBILITY that your copy will be installed or
  201. used on more computers than it is licensed for.  If you have a network,
  202. you don't need to include every computer attached to the network in your
  203. license, but you must include every computer on which the Program is
  204. installed or used, regardless of whether the user of the computer happens
  205. to know that the Program is in use on their system.  If you have single
  206. computers which allow multiple users to use the Program simultaneously,
  207. you must count each keyboard or terminal separately when determining how
  208. many computers are using the Program.

  210. LIMITED DISTRIBUTION LICENSE

  263. This warranty does NOT apply to Evaluation Copies of the Program.

  265. Satisfaction Guarantee.  If you are dissatisfied with any product you buy
  266. from us under this Agreement for any reason, you may return it at any
  267. time up to 30 days after purchase and we will give you a refund. Refunds
  268. will be based on the price you paid, with shipping costs excluded.  You
  269. must contact us before returning any product for a refund. This
  270. satisfaction guarantee does not apply to multi-system licenses for more
  271. than 10 computers, or to purchases of more than 10 individual copies at a
  272. time.

  274. Physical Defects.  We pledge that the disks, if any, and any printed
  275. material we send you will arrive free of physical defects which interfere
  276. with normal use. If you find such a defect and report it to us within 30
  277. days after you get your Registered Package, we agree to replace the
  278. defective item(s) at no charge to you as long as the defect was not
  279. caused by misuse or abuse.

  281. Bugs and Program Errors.  We don't promise that the Software will be free
  282. of bugs or program errors, and you agree that bugs or program errors will
  283. not be considered as "physical defects" in the program. We agree that if
  284. you report a program error or bug to us, we will use our best efforts to
